General Terms and Conditions for nuem (Candidates)

These General Terms and Conditions (“Terms”) govern your participation in the recruitment process provided by nuem ltd. (“nuem”, “we”, “us”, “our”) and apply to all candidates (“Candidate” or “you”) engaging directly with our recruitment services. By submitting an application or participating in any recruitment activity (including video interviews) with nuem, you confirm that you have read, understood, and agreed to these Terms.

1. Acceptance of Terms

1.1 Consent to Terms:
By participating in any recruitment process (including but not limited to submitting your CV, engaging in video interviews, or using our online platform), you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
1.2 Modifications:
nuem reserves the right to modify these Terms at any time. Updated Terms will be posted on our website. Your continued participation after any changes constitutes your acceptance of the revised Terms.

2. Recruitment Process and Candidate Obligations

2.1 Process Overview:
nuem’s recruitment process may include candidate sourcing, pre‑screening, video interviews (one‑way or interactive), assessments, and subsequent candidate evaluations. We use a structured approach, including methods such as the STAR framework and Learning Outcome-based evaluations, to ensure a fair and transparent evaluation of your skills and experience.
2.2 Candidate Responsibilities:

You agree to provide accurate, current, and complete information about your professional background, qualifications, and work history.

You are responsible for preparing your responses, following the guidance provided, and ensuring that your recorded answers are clear and truthful.

You will ensure that your device meets the necessary technical requirements for video interviews and that you are in a suitable environment (quiet and well‑lit) during the interview.

2.3 Interview Recording:
By participating in video interviews, you consent to the recording (video, audio, and/or text) of your responses. These recordings, along with associated data (including transcriptions and evaluation metadata), form part of your Candidate Data, which will be used solely for evaluating your application and supporting your career opportunities.
If you do not wish to participate in a recorded interview, please inform your recruiter to explore alternative arrangements.

3. Data Processing and Privacy

3.1 Data Collection and Use:
nuem collects and processes your Candidate Data – including your CV, contact details, interview recordings, transcriptions, and evaluation data – for the purposes of candidate evaluation, matching with suitable employment opportunities, and future recruitment communications.

When you engage directly with nuem, nuem acts as the Data Controller for your data.

In cases where our Hiring Suite Platform is used on behalf of a client, the client acts as the Data Controller and nuem processes your data solely on their behalf, subject to the terms of the applicable Data Processing Agreement.

We use AI-assisted evaluation tools during our recruitment process to help assess candidate suitability. These tools may provide interview summaries, highlight keyword usage, or identify potential red flags, but all outcomes are reviewed by a human recruiter. All candidate evaluations and hiring decisions are subject to human review.
3.2 Security and Retention:
Your Candidate Data is stored and processed securely in compliance with the GDPR and other applicable data protection laws. We retain your data as long as necessary to support your career opportunities or as required by law. When no longer required, your data will be securely deleted or anonymized.
3.3 Your Rights:
You have rights under the GDPR, including the right to access, correct, delete, or restrict the processing of your data; the right to data portability; and the right to withdraw your consent at any time. Please refer to our Privacy Policy for further details on your rights and how to exercise them.

4. Intellectual Property

4.1 Ownership:
All intellectual property rights in materials, software, and the proprietary technology used in nuem’s recruitment processes (including our video interview platform) remain with nuem or its licensors.
4.2 License to Use Data:
By participating in our recruitment process, you grant nuem a non‑exclusive, royalty‑free, worldwide license to use your Candidate Data solely for evaluating your application and for future recruitment-related communications. This license does not grant nuem any rights to use your data for any other purpose.

5. Confidentiality

5.1 Candidate Information:
nuem treats all Candidate Data with strict confidentiality and employs robust security measures to protect your data from unauthorized access.

5.2 Third-Party Disclosures:
Your Candidate Data will not be disclosed to third parties except as necessary for candidate evaluation, in accordance with applicable law, or as provided for in these Terms and our Privacy Policy.

6. Disclaimers and Limitation of Liability

6.1 Service “As Is”:
The recruitment process and any associated technology (including the video interview platform) are provided on an “as is” basis. nuem does not guarantee uninterrupted or error‑free operation and disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

6.2 Limitation of Liability:
In no event shall nuem’s total liability to you exceed the amount paid by you (if applicable) for any directly purchased recruitment services, which will typically be zero in standard candidate engagement. nuem shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to these Terms or your participation in our recruitment process.

7. AI & Automated Screening Tools
While nuem employs automated tools (including AI‑based evaluations) to assist in the candidate screening process, no final decision regarding your application will be made solely by automated processing. Human review is an integral part of our decision‑making process. Should you wish to receive more information about any automated decision‑making that affects you, please contact us.

8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. General Provisions

9.1 Entire Agreement:
These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and nuem regarding your participation in our recruitment process.
9.2 Amendments:
No amendment or modification of these Terms will be effective unless in writing and signed by nuem. nuem may update these Terms from time to time; updated Terms will be posted on our website, and your continued participation constitutes your acceptance of the revised Terms.
9.3 Severability:
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
9.4 Waiver:
Any failure by nuem to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.
