Candidate Video Interview Terms & Conditions

1. Introduction & Acceptance

By participating in our video interview process (the “Interview”), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not participate. These Terms govern your use of our video interview platform and the processing of your personal data in connection with your application for employment opportunities.

2. Who We Are

nuem ltd. (“nuem”) is a recruitment services provider located at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

  • In some instances, nuem conducts interviews directly as part of our recruitment services (acting as the data controller).

  • In other cases, nuem conducts interviews on behalf of our clients, where the client is the data controller and nuem acts solely as a data processor under separate Data Processing Agreements.

3. Video Interview Process

  • The Interview is conducted via our proprietary video interview platform (“Platform”), MS Teams, Zoom or other Video Conferencing Software, where you will record responses to pre‑set questions in video, audio, or text format.

  • Your responses may be automatically transcribed and analyzed using AI‑based evaluation tools to assist in candidate screening. Human oversight remains an integral part of the final decision‑making process.

4. Data Collection and Processing

  • Candidate Data: For the purposes of the Interview, we collect and process your personal data – including your CV, contact details, video and audio recordings, transcriptions, text responses, and any associated metadata (“Candidate Data”).

  • Purpose: Your Candidate Data will be used solely for candidate evaluation, recruitment, and for future contact regarding employment opportunities.

  • Processing Roles:

    • When nuem acts as the recruitment service provider, nuem is the data controller.

    • When the Interview is conducted on behalf of a client, that client is the data controller and nuem processes your data only on their instructions.

  • AI-based tools may analyse your interview recordings and transcriptions to support the evaluation process. However, all hiring decisions involve human reviewers and no decision will be made based solely on AI.

 

5. Data Storage and Retention

  • Your Candidate Data is stored and processed securely in accordance with the GDPR and applicable data protection laws.

    • Direct nuem Recruitment: Data is retained as long as necessary to support your career opportunities, until you withdraw consent or request deletion.

    • Client-Managed Process: Data is retained for the duration of the recruitment process as determined by the client, subject to any applicable legal retention periods.

  • Where interviews are conducted on behalf of clients, your Candidate Data will be retained for the duration of the recruitment process as determined by the client or, if not otherwise specified, deleted six (6) months after the process concludes.

  • When your data is no longer required or when legally mandated, it will be securely deleted or anonymized.

6. Your Rights

You have the following rights under the GDPR:

  • Access: Request details of the personal data we hold about you.

  • Correction: Request correction of any inaccurate or incomplete data.

  • Deletion/Restriction: Request deletion or restriction of processing when appropriate.

  • Objection: Object to processing based on our legitimate interests or for direct marketing.

  • Data Portability: Request a copy of your data in a structured, commonly used, machine‑readable format.

  • Automated Decision‑Making: Request further details on any automated decision‑making that significantly affects you, and request human intervention if desired.

  • Withdrawal of Consent: If processing is based on your consent, you may withdraw it at any time (which may affect your participation in the recruitment process).

7. Intellectual Property

By participating in the Interview, you grant nuem (and its authorised partners) a non‑exclusive, royalty‑free license to use your Candidate Data solely for candidate evaluation, recruitment purposes, and future contact regarding employment opportunities. This license also permits nuem to share your data with our clients (where applicable) solely for evaluating your suitability for employment.

8. Candidate Obligations

  • You agree to provide accurate, current, and complete information during the Interview process.

  • You are responsible for ensuring that your device meets the necessary technical requirements to record and upload your interview responses.

  • Any misrepresentation or falsification of information may result in disqualification from the recruitment process.

9. Limitation of Liability

  • We will use commercially reasonable efforts to ensure that the Platform operates smoothly and securely. However, we do not guarantee uninterrupted or error‑free operation.

  • Our liability for any breach of these Terms is limited to direct losses caused by our actions, subject to applicable law. We shall not be liable for any indirect, consequential, or punitive damages.

10. Automated Decision‑Making

While we use AI‑based tools to assist in candidate evaluation, no decision affecting your application is made solely by automated processing. A human is always involved in final decision‑making. Should you request further information regarding any automated decision‑making, we will provide details in line with GDPR requirements.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Amendments and Updates

We reserve the right to update or modify these Terms from time to time. Any changes will be communicated to you, and your continued participation in the Interview process constitutes acceptance of the revised Terms.

13. Data Breach Notification

In the unlikely event of a data breach that poses a risk to your rights and freedoms, we will notify you and the relevant supervisory authority in accordance with GDPR requirements.
